Terms and Conditions of Purchase and Website Use

TERMS AND CONDITIONS OF PURCHASE:

Definitions and interpretation

“Online Course” means the easyJet Fearless Flyer Online Course (plus any other Related Products included in the purchase or purchased subsequently) created by FOF Events Ltd and available for viewing online only via a Computer, Tablet, mobile phone or such other similar device.

“Related Products” or “Freedom From Fear System” or “Path Method” include, but are not limited to, some or all of the following products: The Captain’s Commentary, Zoom Call, Ask the Pilot, MP3 player, The Relaxation System, Advanced Psychology Programme, The PROP Technique, Subliminal Conditioning Programme, Turbulence Relief, Guided Meditation Training, Turbulence Measuring System, Support Emails.

“easyJet” means easyJet Airline Company Ltd.

“Us” or “We” means FOF Events Ltd

“Promoter” means the person firm or company staging the Online Course if different from Us.

“Zoom Call” means a live or recorded video call with the Fearless Flyer Team on an individual or group basis and hosted on a third party platform including but not limited to Zoom Video Communications

Price and payment
The price of the Online Course shall be the price set at the time we accept your order. All prices set are inclusive of any applicable taxes. No access to Online Course will be available until we have received full payment of the cost of the Online Course.
Delivery/Access
You will be given access to our Online Course via a unique login to our members site (which will be sent to you via email) but only once full payment has been made for your own viewing use only. Any included Related Products will be issued by email containing website links. Related Products, where included in the purchase can be either downloaded or accessed online via a web browser from the provided weblinks. In addition, it is possible to access some of the Related Products offline using third party Apps including, for instance, View on the Go, however, we do not at any time guarantee the functionality, performance or compatibility of any App and there may be times where mobile device manufacturers upgrade their hardware beyond the capability or compatibility of an App. We accept no liability should you not be able to access the Related Products offline.
Experience Flight
If your purchase of the Online Course includes the option to buy a seat on one of our Fearless Flyer Experience Flights at a future date, the only person entitled to take the flight will be the person who made the original booking unless we are advised with 72 hours of the date of purchase of the Online Course by email to info@fearless-flyer.com of the name of the person who the course was purchased for and subject to us acknowledging receipt of that email. If that person is under the age of 16 at the time of the flight they will need to be accompanied on the Experience Flight by a full paying adult. Terms and Conditions of the Experience Flight will apply and will be notified to you at the time of the purchase of the flight. The price of the Experience Flight will be offered at the same price as offered to our past full Live Course participants wishing to take a further Experience Flight only. Availability of Experience Flight seats is not guaranteed and is subject to capacity.
Zoom Calls
These video calls may form part of a live course or may be offered as a stand alone support product. We reserve the right to cancel or reschedule a Zoom Call with or without notice for any reason.The calls will be recorded and participants may turn their camera off during the call if they do not wish their image to be recorded. We reserve the right to pubish these calls on any private or publically hosted website for viewing by third parties. We reserve the right to remove any individual from a Zoom Call if we feel in our absolute discretion that their participation is not in the interest of others on the call. Indivdual zoom calls can be rescheduled by mutual agreement subject to 48 hour notice prior to the original scheduled start time and if you fail to attend a scheduled individual zoom call within 20 minutes of the agreed start time, your zoom session will be deemed to have taken place and is not capable of being rescheduled. All zooms calls are non-refundable as further expressed in Clause 5 below.
Refunds
Our Online Course cannot be refunded after purchase under any circumstances.
Breach of Agreement
easyJet Fearless Flyer Online Course is copyright protected. With the exception of the Related Products it is not permitted to downloaded the Online Course. Recording or Publishing of the Online Course or any of the Related Products is strictly prohibited and you may not share your unique login details with any other party and to do so is a breach of the terms of use of this agreement and is against the law. Please note that your IP address is linked to your login details and if our tracking system suspects a breach of this statement or of our general terms and conditions then we reserve the right to permanently suspend your access to the Online Course without notice or penalty.
Assignment
We shall be entitled to assign any of our rights and obligations under these Terms and Conditions provided that your rights are not adversely affected.
Severability
If it is found by a Court that any of these Terms and Conditions for any reason cannot be enforced, this shall not prevent the other provisions from continuing to apply.
Third Parties
Any person, other than easyJet, not a party to these Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions. The Act can give rights under some contracts to third parties who are not parties to those contracts but in this case only We, FOF Digital, easyJet and You (or your assignees permitted hereby) have rights and obligations under this contract.
Amendments and variations
We intend to rely on the written terms set out here in this document. You should therefore read the terms and conditions carefully before entering into the contract to ensure you are happy to be bound them.
No Partnership or Agency
Nothing in these Terms and Conditions and no action taken by You or Us under these Terms and Conditions shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other relationship between You and Us beyond the relationship created under these Terms and Conditions.
Advice
Please do not rely on any information contained within the Online Course as an alternative to medical advice, treatment or care from a medical doctor or other professional healthcare provider.
No Warranties
The information contained within the Online Course is provided without any representations or warranties, expressed or implied.
Entire agreement
These Terms and Conditions and any specially agreed terms constitute the entire agreement between the parties in connection to, its subject matter and supersede any previous terms and conditions, agreement or arrangement between the parties. Each of the parties agrees that it has not entered into these Terms and Conditions in reliance on, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity (whether negligently or innocently made) by any person (whether party to these Terms and Conditions or not) other than as expressly set out in these Terms and Conditions. Nothing in this clause shall operate to limit or exclude any liability for fraud.
Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in all respects in accordance with English Law and the parties irrevocably agree to submit to the exclusive jurisdiction of the English courts to settle any claims or disputes which may arise under or in connection with this Agreement.
